1. What Tripofreak is — and what it is not

Tripofreak ("we", "us", "our") is an AI-powered travel itinerary planning tool. We help you plan trips by generating day-by-day itinerary suggestions based on your destination, preferences, and travel style.

Tripofreak earns affiliate commission from these platforms when you make a booking through our links, at no extra cost to you. This commission does not influence our recommendations.

2. Our itineraries are suggestions, not guarantees

The itineraries, activity suggestions, cost estimates, restaurant recommendations, and travel tips generated by Tripofreak are produced by AI and provided for informational and planning purposes only. They are based on general knowledge and may not reflect current conditions.

We make no guarantee that:

• Any attraction, restaurant, or accommodation mentioned will be open, available, or unchanged when you visit
• Cost estimates will match actual prices at the time of your trip
• Transport options, permit requirements, or entry rules will remain as described
• Weather, crowd levels, or safety conditions will match our suggestions
• Affiliate booking links will always be available or reflect current pricing

Always verify critical travel information — visa requirements, permit bookings, safety advisories — through official government and embassy sources before travelling. Tripofreak's Freaky Finds alerts are informational only and do not substitute for official travel advisories.

3. Your account

You must sign in with a Google account to use Tripofreak. By signing in, you confirm that:

• You are at least 18 years old
• The Google account you use belongs to you
• You will not share your account or premium access with other people
• You will not use automated scripts or bots to generate itineraries

One premium purchase applies to one account. Sharing premium access violates these terms and may result in account suspension.

4. Payments and refunds

Tripofreak offers paid premium plans processed by Razorpay (India) and Stripe (global).

Refund policy: Because our product is a digital service delivered instantly upon payment (the AI generates your full itinerary immediately), premium plans are non-refundable once the itinerary has been generated. This applies under the digital goods exception in consumer protection law.

Exceptions — we will issue a full refund if:

• You were charged but the itinerary was not generated due to a technical error on our side
• You were charged twice for the same plan

For refund requests, email hello@tripofreak.com within 48 hours of purchase with your payment ID. We will respond within 72 hours.

5. Acceptable use

You agree not to:

• Use Tripofreak for any illegal purpose
• Attempt to reverse-engineer, copy, or replicate our AI prompts or system
• Use automated tools to mass-generate itineraries
• Resell or commercialise itineraries generated by Tripofreak without our written permission
• Submit false, misleading, or harmful content through our input fields
• Attempt to circumvent rate limits, payment gates, or premium access controls

Violation of these terms may result in immediate account suspension without refund.

6. Third-party links and affiliate disclosure

Tripofreak displays affiliate links to third-party travel booking platforms. When you click these links and make a purchase, we may earn a commission. This is disclosed on every itinerary page and in our footer.

We are not responsible for the content, pricing, availability, terms, or practices of any third-party platform. Your relationship with MakeMyTrip, Booking.com, Agoda, Cleartrip, Expedia, TripAdvisor, Klook, ixigo, or any other platform is governed by their own terms and policies.

Tripofreak's recommendations are based on travel knowledge and user preferences. Affiliate relationships do not influence which destinations, attractions, or activities we recommend.

7. Limitation of liability

To the maximum extent permitted by applicable law, Tripofreak and its operator are not liable for:

• Any loss, injury, damage, or expense arising from a trip planned using Tripofreak
• Inaccurate, outdated, or incomplete information in our itineraries
• Any booking made through a third-party platform linked from Tripofreak
• Travel disruption, cancellation, scams, theft, illness, or accidents during your trip
• Loss of data due to technical issues beyond our control

Tripofreak's maximum liability for any claim is limited to the amount you paid for your premium plan in the 30 days before the claim arose.

8. Intellectual property

The Tripofreak name, logo, design, and product concept are owned by us. Our AI system prompt and itinerary generation logic are our proprietary intellectual property.

The itineraries we generate for you are yours to use for personal travel planning. You may share them with your travel group. You may not resell them, publish them commercially, or use them to train AI models without our written permission.

9. Governing law and disputes

These terms are governed by the laws of India. Any dispute arising from your use of Tripofreak shall first be attempted to be resolved through good-faith communication with us at hello@tripofreak.com.

If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Chandigarh, India.

For EU users: nothing in these terms removes your rights under applicable EU consumer protection law, including your right to bring a claim in your country of residence.

10. Changes to these terms

We may update these terms from time to time. If we make significant changes, we will notify you by email. Continued use of Tripofreak after the change means you accept the updated terms.
